YAKAMA NATION  ZONING ADMINISTRATION

PHILOSOPHY: ".., Encourage compatible use, balance preservation of natural and cultural sites with development for economic growth, be responsive to the public and always include community and tribal values and priorities…,"

 The controls as set forth in this ordinance are deemed necessary in order to encourage the most appropriate use of the land; to protect the social and economic stability of residential, agricultural, commercial, industrial, forest, reserved and other areas within the reservation, and to assure orderly development of such areas and; to obviate the menace to the public safety resulting from the improper location of buildings and the uses with existing and proposed traffic movement on said highways; and to otherwise promote the public health, safety, morals and general welfare in accordance with the rights by the Yakama Indian Nation in the ‘Treaty with the Yakamas’ (12 Stat. 951).

APPLICATION. 
Interview to document existing uses, proposed uses and impacts of proposed use. Public hearing for requests that require approval and exception.

DECISION. 
The proposed use is reviewed land committee of tribal council. 
NOTICE TO APPLICANT OF DECISION IS MADE AND IF APPROVED ARE SENT A LETTER LISTING CONDITIONS. IF DENIED, CAN BE APPEALED AND RECONSIDERED WITH VALID BASIS OR NEW INFORMATION.

FEE FOR LAND USE PERMIT. 
ALL LAND USE ARE REVIEWED BY SEVERAL PROGRAMS AND ORGANIZATIONS DEPENDING ON THE NATURE OF THE REQUEST AND LOCATION, FOR COMMENT ON PROPOSED USE. A FEE IS CHARGED AND PAID AT CENTRAL ACCOUNTING.

APPLICABLE/ELIGIBLE APPLICANTS.
TRIBAL MEMBERS OWNING OR BUYING TRUST AND FEE LANDS. NON-MEMBERS LEASING TRUST LANDS, ALL PEOPLE LEASING TRIBAL LANDS.

1500 PERMITS HAVE BEEN ISSUED SINCE 1972, MAJORITY for homesite use, all use categories ARE PROCESSED.

LAND USE IS THE PRIMARY PURPOSE AND NOT "BUILDING PERMIT." 
OTHER ACTIVITIES INCLUDE, ASSISTANCE, COMPLAINTS, ENFORCEMENT, MONITORING LAND USE, VIOLATION AND SPECIAL
